{"id":3625,"date":"2025-07-21T12:19:03","date_gmt":"2025-07-21T10:19:03","guid":{"rendered":"https:\/\/livingandworking.eu\/?p=3625"},"modified":"2025-07-21T12:19:04","modified_gmt":"2025-07-21T10:19:04","slug":"overtime-in-germany-tax-free-in-france","status":"publish","type":"post","link":"https:\/\/livingandworking.eu\/en\/2025\/07\/21\/overtime-in-germany-tax-free-in-france\/","title":{"rendered":"Overtime in Germany: tax-free in France?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Good news for frontier workers (tax status) living in France and working in Germany: under certain conditions, overtime worked in Germany may be exempt from income tax in France!<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But beware: this exemption is not automatic for everyone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Here&#8217;s what you need to know.<\/p>\n\n\n\n<div class=\"wp-block-eures-plugin-accordion-block\"><div class=\"accordion-top\"><p class=\"accordion-title\">An exemption governed by French law<\/p><svg viewBox=\"0 0 24 24\" stroke-width=\"1.5\" fill=\"none\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"accordion-top__icon\"><path d=\"M3 12L21 12M21 12L12.5 3.5M21 12L12.5 20.5\" stroke-width=\"1.5\" stroke-linecap=\"round\" stroke-linejoin=\"round\"><\/path><\/svg><\/div><div class=\"accordion-content\">\n<p class=\"wp-block-paragraph\">Since 2019, overtime worked in excess of the legal working week has been eligible under French law for income tax exemption, subject to certain limits and conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, this exemption is reserved for employees covered by the French Labour Code, as it only applies to hours that also give entitlement to a reduction in social security contributions.<\/p>\n<\/div><\/div>\n\n\n\n<div class=\"wp-block-eures-plugin-accordion-block\"><div class=\"accordion-top\"><p class=\"accordion-title\">What about cross-border commuters working in Germany?<\/p><svg viewBox=\"0 0 24 24\" stroke-width=\"1.5\" fill=\"none\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" class=\"accordion-top__icon\"><path d=\"M3 12L21 12M21 12L12.5 3.5M21 12L12.5 20.5\" stroke-width=\"1.5\" stroke-linecap=\"round\" stroke-linejoin=\"round\"><\/path><\/svg><\/div><div class=\"accordion-content\">\n<p class=\"wp-block-paragraph\">In principle, an employee working abroad, in a foreign company, is not subject to French social legislation, and therefore cannot benefit from the exemption provided by national law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, an exception applies to cross-border commuters, thanks to the tax treaty between France and Germany.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Article 13(5) of the Franco-German tax treaty, frontier workers are only taxable in France on their German business income.
